These Terms of Use (“Terms”) govern your access to and use of the BantuSocial platform, including our website, mobile applications, subscriptions, social networking services, marketplace features, business tools, referral programmes, communications services, content, digital services and any other products or features that we may make available from time to time (collectively, the “Service”).
In these Terms, “BantuSocial”, “we”, “us” and “our” refer to the operator of the BantuSocial platform. “User”, “you” and “your” refer to any person accessing or using the Service.
By creating an account, purchasing a subscription, accessing or using BantuSocial, you acknowledge that you have read, understood and agreed to be bound by these Terms and our Privacy Policy.
If you do not agree with these Terms, you should not access or use BantuSocial.
1. Acceptance of Terms
By registering for, accessing or using BantuSocial, you agree to comply with these Terms, our Privacy Policy, Community Guidelines, subscription conditions and any additional policies or programme rules that apply to particular BantuSocial services.
Where a specific feature, promotion or programme has additional terms, those additional terms form part of your agreement with BantuSocial.
Nothing in these Terms is intended to exclude or limit any rights that cannot lawfully be excluded under applicable South African law.
2. Eligibility

Where applicable law requires parental or guardian consent for a minor to use certain services, the required consent must be obtained.
Certain features, including financial, commercial, marketplace, business or promotional features, may have higher age requirements.
By using BantuSocial, you represent that you meet all eligibility requirements applicable to the services you use.
3. User Accounts
You may be required to create an account to access certain BantuSocial services.
You agree to:
- provide accurate and current information;
- keep your account information reasonably up to date;
- protect your password, PIN, OTP and other account credentials;
- not impersonate another person or organisation;
- not create accounts using intentionally false or misleading identities;
- not sell, transfer or improperly share your account;
- promptly notify us if you believe your account has been compromised.
You are responsible for activity conducted through your account to the extent permitted by applicable law.
We may require identity, telephone number, email or other verification where reasonably necessary for security, fraud prevention, regulatory compliance or access to particular services.

BantuSocial is a social and socio-economic digital platform designed to connect people, communities, businesses, creators and opportunities.
Depending on availability and development, BantuSocial may provide features relating to:
- social networking;
- messaging and communication;
- groups and communities;
- local business discovery;
- marketplaces;
- business pages and tools;
- jobs and opportunities;
- events;
- content creation;
- news and community information;
- promotions and advertising;
- loyalty and rewards;
- digital services;
- creator tools;
- community initiatives; and
- other social and commercial functionality.
Features may be introduced, changed, improved, replaced or discontinued as the platform develops.
5. User Content
You retain ownership of content that you create and upload to BantuSocial, subject to any third-party rights that may apply.
“User Content” may include posts, photographs, videos, audio, comments, reviews, advertisements, business information, messages and other material submitted through the Service.
By submitting User Content, you grant BantuSocial a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display, distribute and otherwise use that content to the extent reasonably necessary to operate, improve, secure and promote the Service.
You represent that you have the necessary rights or permissions to submit the content.
You must not knowingly upload content that:
- violates applicable law;
- infringes intellectual property rights;
- unlawfully violates another person's privacy;
- constitutes unlawful hate speech;
- contains unlawful threats or harassment;
- promotes criminal activity;
- contains malicious software;
- is fraudulent or intentionally deceptive;
- unlawfully exploits children or vulnerable persons; or
- otherwise violates BantuSocial policies.
We may moderate, restrict or remove content where reasonably necessary to enforce these Terms, protect users or comply with legal obligations.
6. Prohibited Conduct
You agree not to misuse BantuSocial.
Prohibited conduct includes:
- using the Service for unlawful purposes;
- attempting unauthorised access to accounts, systems or data;
- distributing viruses, malware or malicious code;
- deliberately interfering with the operation or security of the Service;
- conducting fraudulent transactions;
- manipulating referral systems or rewards;
- creating fake accounts to obtain commissions or benefits;
- creating artificial referrals or subscriptions;
- misrepresenting BantuSocial as an investment opportunity;
- making false or misleading earnings claims;
- representing referral commissions as guaranteed income;
- using spam or unlawful marketing methods to obtain referrals;
- harassing users to subscribe or participate in referral programmes;
- impersonating BantuSocial or its representatives;
- scraping or extracting platform data in violation of applicable law or our policies; or
- using BantuSocial in a manner that causes unlawful harm to another person.
Violation may result in restriction, suspension or termination of an account and, where appropriate, cancellation of improperly obtained rewards.
7. Intellectual Property and Platform Ownership
Except for User Content and third-party material, BantuSocial and its associated software, branding, designs, interfaces, databases, graphics, trademarks, logos and other intellectual property are owned by BantuSocial, its operator or its licensors.
Access to BantuSocial does not transfer ownership of our intellectual property to users.
You may not copy, sell, reproduce, modify, reverse engineer, distribute or commercially exploit protected BantuSocial intellectual property except where authorised by us or permitted by applicable law.
8. Subscriptions and Platform Value
8.1 Subscription-Based Service
BantuSocial may offer free and paid services.
Paid subscription plans provide access to specified platform services, features, tools, functionality or other benefits according to the selected plan.
Available plans, prices and benefits may change from time to time.
8.2 Subscription Is an Exchange for Value
A BantuSocial subscription represents an exchange of payment for value provided by the platform.
Subscribers pay for access to the features, services, tools and benefits associated with their selected subscription.
Subscription revenue also supports the continued operation and development of the BantuSocial initiative and may contribute toward expenses such as:
- technology infrastructure;
- software development;
- hosting;
- security;
- customer support;
- personnel;
- administration;
- marketing;
- regulatory compliance;
- innovation;
- platform maintenance; and
- expansion.
Subscribers should select a subscription based primarily upon the services and value provided by BantuSocial.
9. Subscription Is Not an Investment
This is an important condition of using BantuSocial.
A BantuSocial subscription is NOT an investment.
Purchasing or renewing a subscription does not constitute:
- an investment of capital;
- a financial deposit;
- a loan to BantuSocial;
- the purchase of securities;
- the purchase of shares or ownership in BantuSocial;
- a savings product;
- an interest-bearing arrangement;
- an income-generating financial instrument;
- an entitlement to company profits; or
- a promise of financial return.
Subscribers do not receive equity, ownership, dividends, interest or investment returns merely because they have purchased a subscription.
Subscription fees purchase access to platform value. They are not invested for financial returns.
10. Subscription Plans
BantuSocial may offer different subscription tiers, including plans at different price points.
Different plans may provide different features, usage allowances, services, business tools, marketplace functionality, promotional capabilities or other benefits.
The existence of different subscription prices must not be interpreted as representing different investment levels.
A more expensive subscription does not mean that a user has made a larger investment or purchased a guaranteed right to greater financial returns.
Current pricing and benefits will be communicated through the platform or other official BantuSocial channels.
11. Payments, Renewals, Cancellations and Refunds
Users are responsible for subscription fees and other charges they authorise through BantuSocial.
Where subscriptions automatically renew, the applicable billing frequency and renewal conditions will be communicated to users.
Users may cancel future subscription renewals using the available cancellation procedure, subject to applicable terms and law.
Payments already processed may be non-refundable where legally permitted.
However, nothing in these Terms excludes any refund, cancellation, cooling-off, remedy or other consumer right that BantuSocial is legally required to provide under applicable South African law.
12. Optional Referral and Community Growth Programme
12.1 Participation Is Entirely Optional
BantuSocial may operate referral, affiliate, ambassador, community-growth or promotional programmes from time to time.
Participation in these programmes is entirely optional.
A subscriber is not required to:
- recruit another person;
- build a team;
- establish a network;
- achieve recruitment targets;
- refer friends or family;
- continuously introduce new subscribers; or
- participate in promotional activity
in order to use the ordinary BantuSocial platform and receive the benefits associated with their subscription.
A user may remain a BantuSocial subscriber without referring a single person.
13. Purpose of Referral Commissions
Where BantuSocial offers referral commissions, rewards or incentives, their purpose is to encourage and recognise legitimate marketing, promotion, customer acquisition and collective community-growth efforts.
Instead of relying exclusively on traditional advertising, BantuSocial may choose to allocate part of its marketing and customer-acquisition resources toward eligible members who voluntarily contribute to the growth of the platform.
Referral commissions therefore constitute a marketing and promotional incentive.
They are not the underlying product sold by BantuSocial.
14. Referral Commissions Are Not Investment Returns
Referral commissions, bonuses, rewards or other promotional incentives must not be interpreted or represented as:
- investment returns;
- return on investment (“ROI”);
- interest;
- dividends;
- guaranteed passive income;
- profit sharing;
- appreciation of invested capital;
- guaranteed wages;
- guaranteed salary; or
- guaranteed financial gain.
Users are rewarded, where applicable, for qualifying promotional activity — not for investing money.
Payment of a subscription fee alone does not automatically create an entitlement to commissions.
15. No Guaranteed Earnings
BantuSocial makes no guarantee that any subscriber will earn money through a referral or promotional programme.
Any earnings examples, commission tables, presentations, diagrams, calculators, illustrations, marketing materials or network scenarios provided by BantuSocial are intended solely to demonstrate how a programme could operate under specified assumptions.
They are not guarantees, promises or forecasts of actual income.
Actual referral commissions may depend upon applicable programme rules, eligible referrals, qualifying subscriptions, active subscriptions, renewals, cancellations, compliance requirements and other conditions.
Individual results may vary significantly.
16. Illustrative Earnings Disclaimer
Where BantuSocial displays potential referral commissions, those figures should be understood as illustrative referral commission scenarios only.
For example, a demonstration based upon a hypothetical network of users does not represent a promise that a subscriber will establish such a network or receive the illustrated amount.
Users must not present hypothetical BantuSocial earnings calculations to other people as guaranteed or expected financial results.
BantuSocial may take action against accounts deliberately using misleading income representations to recruit subscribers.
17. Referral Programme Is Not Guaranteed to Continue
The BantuSocial referral programme is a marketing and promotional strategy and is not guaranteed to exist permanently.
Subject to applicable law and legally accrued rights, BantuSocial reserves the right to:
- modify commission percentages;
- change qualification requirements;
- modify referral levels;
- introduce promotional campaigns;
- reduce commissions;
- increase commissions;
- change programme structures;
- establish maximum commission limits;
- suspend particular incentives;
- temporarily pause the programme; or
- discontinue the referral programme.
BantuSocial may make these changes where reasonably necessary for commercial sustainability, regulatory compliance, fraud prevention, platform development or other legitimate business purposes.
Subscribers therefore should not purchase a subscription solely because they expect referral commissions to continue indefinitely.
18. No Right to Recruitment-Based Income
Purchasing a BantuSocial subscription does not purchase a right to recruit other users for financial gain.
Users purchase access to BantuSocial's platform and associated services.
Where commissions are offered, they are governed by separate eligibility and programme requirements relating to qualifying promotional or customer-acquisition activities.
BantuSocial may reject commissions arising from fake accounts, fraudulent subscriptions, self-referral manipulation, unauthorised transactions or other conduct that violates programme rules.
19. BantuSocial Is a Socio-Economic Platform
BantuSocial is designed as an African socio-economic digital ecosystem connecting individuals, communities, businesses, entrepreneurs, creators and opportunities through technology.
Our objective is to create genuine utility through services including social networking, business discovery, digital commerce, marketplaces, employment and opportunity discovery, communication, content creation, events, community participation and other digital services.
The long-term sustainability of BantuSocial is intended to come from providing useful services and building genuine economic activity within the platform.
20. BantuSocial Is Not Designed as a Pyramid or Get-Rich-Quick Scheme
BantuSocial does not position its subscriptions as investments or guaranteed income opportunities.
The platform is designed to provide value independently of its optional referral programme.
Users should subscribe because they value the services, functionality, community and opportunities available through BantuSocial — not because they have been promised guaranteed financial returns.
The continued recruitment of new subscribers is not intended to be the underlying product or sole economic purpose of BantuSocial.
Our guiding principle is:
People do not exist to sustain the model. The model exists to serve people.
21. Sustainable Business Model
BantuSocial is intended to develop a diversified and sustainable commercial ecosystem.
Subject to the services ultimately offered, revenue may be generated through sources including:
- subscriptions;
- advertising;
- business tools;
- premium features;
- promoted content;
- business pages;
- marketplace-related services;
- digital services;
- events;
- commercial partnerships;
- promotional services; and
- other lawful commercial activities.
This diversified approach is intended to support BantuSocial's long-term operation without making its existence dependent exclusively upon referral activity.
22. Separation Between Subscription and Referral Activity
BantuSocial applies the following principle:
You subscribe for value. You refer by choice.
Subscription and referral activity are distinct concepts.
A subscriber may use BantuSocial without participating in referrals.
Where an eligible subscriber voluntarily participates in an available referral programme, qualifying commissions represent promotional incentives and not returns on the subscriber's subscription payment.
23. Community and Economic Impact
BantuSocial seeks to use technology to contribute toward positive social and economic participation.
Our broader objectives include:
- improving digital connectivity;
- strengthening communities;
- helping local businesses become discoverable;
- enabling entrepreneurs to reach customers;
- supporting creators;
- improving access to opportunities;
- facilitating community commerce;
- promoting digital participation;
- supporting employment and skills opportunities;
- encouraging local economic activity; and
- building digital infrastructure designed around African communities.
These objectives describe the intended purpose of BantuSocial and do not constitute guarantees that particular economic or social outcomes will occur.
24. Marketplace and Third-Party Transactions
Where BantuSocial allows users or businesses to advertise, buy, sell, promote or provide products or services, those transactions may involve independent third parties.
Unless expressly stated otherwise, BantuSocial is not the seller or provider of third-party products or services.
Users are responsible for evaluating sellers, buyers, service providers and opportunities before entering into transactions.

25. Business and Promotional Content
Businesses and users are responsible for the accuracy and legality of advertisements, promotions, listings and commercial representations they publish through BantuSocial.
Businesses must not use BantuSocial to conduct fraudulent, deceptive or unlawful commercial activity.
Paid or sponsored content may be identified where required.
26. Privacy and Data Protection
BantuSocial processes personal information in accordance with its Privacy Policy and applicable data-protection requirements.
Users should review the Privacy Policy to understand how information may be collected, used, stored and protected.
Where appropriate, users may have rights relating to access, correction, deletion or other processing of their personal information under applicable law.
27. Security
We take reasonable measures to protect the platform and user information.
However, no internet service, application, database or electronic communication system can be guaranteed to be completely secure.
Users are responsible for taking reasonable precautions to protect their accounts and devices.
28. Suspension and Termination
BantuSocial may restrict, suspend or terminate access to all or part of the Service where reasonably necessary, including where:
- these Terms are materially violated;
- fraud is suspected;
- referral manipulation occurs;
- platform security is threatened;
- unlawful conduct occurs;
- another person's rights are seriously violated; or
- continued access creates material legal or security risk.
Where required by applicable law, appropriate notice or remedies will be provided.
29. Disclaimer of Warranties
To the fullest extent permitted by applicable law, BantuSocial is provided on an “as is” and “as available” basis.
We do not guarantee uninterrupted availability or that every feature will always remain unchanged or error-free.
Scheduled maintenance, technical failures, cybersecurity incidents, network problems and circumstances outside our reasonable control may affect availability.
Nothing in this section excludes warranties or consumer protections that cannot lawfully be excluded.
30. Limitation of Liability
To the fullest extent permitted by applicable law, BantuSocial and its operator will not be liable for indirect, incidental, special or consequential loss arising from use of the Service where such liability may lawfully be limited.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
31. Changes to the Platform
BantuSocial is an evolving technology platform.
We may introduce, remove, modify or improve features, interfaces, subscription benefits and services as the platform develops.
Not every feature is guaranteed to remain available permanently.
Material changes affecting paid services will be handled in accordance with applicable law and our contractual obligations.
32. Changes to These Terms
We may update these Terms to reflect changes to the Service, our business model, legislation, regulatory requirements or platform policies.
Where changes are material, we may provide reasonable notice through BantuSocial, email, our website or another appropriate communication method.
The updated Terms will state their effective date.
33. Governing Law
These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory consumer or other legal protections that may apply.
Disputes will be handled in accordance with applicable South African law and the jurisdiction of competent South African courts.
34. Severability
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the extent necessary where legally possible.
The remaining provisions will continue to apply.
35. Entire Agreement
These Terms, together with the Privacy Policy and any applicable programme-specific terms, constitute the agreement governing your use of BantuSocial.
Programme-specific terms may supplement these Terms for particular services or promotions.
